The Official Rules apply to the “AliExpress Members’ Day – December Lucky Star” promotional campaigns, games, and/or events (each, a “Promotion”) available on and in the website website identifiably by the uniform resource locator http://www.aliexpress.com (both web and mobile versions) and the AliExpress mobile applications (iOS and Android) (collectively, the “AliExpress Platform”).
1. The Promotion
On the December Members’ Day (as defined in Clause 2), AE Members (as defined in Clause 5) that have completed payments on the AliExpress Platform have the chance to win Finland Aurora Trip, AliExpress Coupons, or other forms of rewards offered by the Promoter.
2. December Members’ Day
The December Members’ Day is 8 December 2019, which starts at 00:00:00 on 8 December 2019 Pacific Standard Time (“PST”) and ends at 23:59:59 on 8 December 2019 PST.
3. Promoter
Alibaba.com Singapore E-Commerce Private Limited, a company incorporated in Singapore with its registered office at 10 Collyer Quay # 10-01, Ocean Financial Centre, Singapore 049315, is the promoter of the Promotion (the “Promoter”).
4. Availability
The Promotion is available on the event page of the December Members’ Day. The Promotion and the event page will be made available to all users of the AliExpress Platform who may access and read the relevant information on the Promotion through Push, “My AliExpress”, member pages and other channels.
5. Eligible Member
You must be an AliExpress Member (“AE Member”) to participate in the Promotion. An AE Member is anyone (i) who is a registered member of the AliExpress Platform, and (ii) who is NOT an employee, officer, director and/or agent of the Promoter, or any affiliates of the Promoter, nor an immediate family member of any such employee, officer, director and/or agent.
6. Promotion-specific Rules
6.1 OfferOffersOffer
(a) The rewards (each, an “Offer”) that an AE Member may win in respect of the Promotion in accordance with the Official Rules include:
(i) Finland Aurora Trip: a 4-night stay in a hotel in Finland with one round-trip air ticket (“Finland Aurora Trip”), which is sponsored by Business Finland Oy, a Finland company with registered address at Porkkalankatu l, 00180 Helsinki, Finland ("Visit Finland" or the “Sponsor”);
(ii) AliExpress Coupon of US$ 3 (three US dollars), which can be used for a transaction of US$ 20 or more (each – an “AliExpress Coupon Offer”).
(b) The AE member who is the 8th, 88th, 888th, and/or 8888th person to purchase product(s) participating in the Promotion which are listed on the promotion page and complete payment of the relevant order(s)
(c) The AE Member who is the 1208th person to complete payment of the order(s) on the AliExpress Platform will be awarded the Offer of Finland Aurora Trip.
(d) Sequence of AE Member(s) who participated in the Promotion will be subject to tracking of AliExpress system. Except for winners of the Offers, the sequence of AE Member(s) who participated in the Promotion will be kept in confidence.
6.2 If your Offer is Finland Aurora Trip:
(a) the claiming of the Offer shall be carried out directly between you and Visit Finland and/or its designated partner;
(b) the Promoter will contact and inform you within 10 days after the end of the Promotion by sending an official email to your registered email with the AliExpress Platform;
(c) the Promoter will provide Visit Finland and/or its designated partner with your Account ID and contact information; and
(d) you shall use the Account ID to contact Visit Finland and/or its designated partner to verify your identity.
6.3 If your Offer is AliExpress Coupon, it will be automatically credited to your AE Member’s account within 10 days after the end of the Promotion.
6.4 Important reminders:
(a) AliExpress Coupons are not legal tender and not transferrable or exchangeable for cash.
(b) OfferAn Offer is not transferrable, refundable, and/or exchangeable for cash.
(c) The availability of the hotel and the round-trip air ticket is subject to the arrangement of such sponsors as Visit Finland, the airline company and/or the hotel. It is important for you to follow all the steps required by Visit Finland and/or its designated partner for the claiming of the Offer of Finland Aurora Trip. Failure to do so may affect your travel arrangements.
(d) Anything not explicitly stated in the Official Rules is not included in the Offer. AE Member who wins the Offer of Finland Aurora Trip shall bear all the expenses, fees and taxes (if any) related to the trip (e.g. VISA application, meals, and offers and services), except for the 4-night hotel in Finland with one round-trip air ticket offered by Visit Finland and/or its designated partner.
(e) The Promoter reserves the right and absolute discretion to cancel or revoke the Luck Reward rewarded to any AE Member, if, in the opinion of the Promoter, the reward of that AE Member involves or is related to any fraudulent, dishonest, unlawful and/or unfair acts or practices when participating in the Promotion.
7. General Rules:
(a) By participating in the Promotion, you agree to be bound by the Official Rules.
(b) Any fraud and/or abuse of offers (e.g. AliExpress Coupons and/or other forms of rewards) awarded/received under the Promotion (“Offers”) to/by you (as determined by the Promoter at its sole discretion) will result in forfeiture of your Offers and subject your account(s) to penalties according to the rules released by the Promoter, including cancellation of your account(s). The Promoter also reserves the right to deduct the value of any Offers awarded inappropriately to you directly from your account(s) without prior notice, and/or take further legal actions in such instances to ensure the obtaining of adequate remedies.
(c) In the event that the Promotion is suspended, cancelled, ceased, and/or inoperable by the relevant authorities or due to network incidents, malfunction and failure in any part of the system, and/or other reasons, the Promoter may terminate the Promotion at any time as it thinks appropriate, and the Promoter shall not be liable for damages or claims of any kind that arise out of such termination.
(d) The Promoter is not responsible for any late, lost, delayed, incomplete, illegible, misdirected or undeliverable entries, responses, or other correspondence, whether by e-mail or otherwise, nor responsible for any consequences, whether foreseeable or not, which arise out of or are caused by any of the foregoing.
(e) Time and validity of any transactions and/or your eligibility to the Offers shall be determined by the Promoter at its sole discretion based on the Promoter’s record. If there is any discrepancy between the record of transaction held by you and that held by the Promoter, the Promoter’s record shall be conclusive and binding on you.
(f) The Promoter reserves the right to amend the Official Rules as well as to vary or terminate any of the Offers without prior notice. In the event of disputes, the decision of the Promoter shall be final and binding.
(g) The Promoter reserves the right and absolute discretion to cancel or revoke your right to participate in a Promotion or use any Offers, upon discovery of your violation of the Official Rules, or, in the opinion of the Promoter, any dishonest, malicious, fraudulent, unlawful, and/or inappropriate acts during your participation in any Promotion.

8. Additional Terms and Conditions for AliExpress Coupon
If you receive AliExpress Coupons as Offers, the terms and conditions under this Clause 8 shall also apply:
(a) Your account on the AliExpress Platform will be automatically credited with the Offers upon your acceptance of such Offers.
(b) The Offers can only be used within 7 days upon receipt of such Offers on your account (the “Usage Period”).
(c) In the case of AliExpress Coupons as Offers:
(i) AliExpress Coupons that remain unused after the Usage Period will lapse and cannot be refunded or exchanged for anything; and
(ii) AliExpress Coupons may not be used for certain regions and/or products and/or shipping purposes as may be decided by AliExpress.com from time to time.
(d) In the case of AliExpress Select Coupons as Offers:
AE Members can use the AliExpress Select Coupons at participating stores in accordance with the minimum purchase requirement laid down by the respective merchant. For instance:
(i) If the merchant allows a coupon with value of US$10 to be used on an order of US$99 or above, then an AE Member can use five (5) coupons (i.e. making up US$10 in value) when he/she makes a purchase of products of US$99 or more at that merchant’s store;
(ii) If the merchant allows a coupon with value of US$4 to be used on an order of US$39 or above, then an AE Member can use two (2) coupons (i.e. making up US$4 in value) when he/she makes a purchase of products of US$39 or more at that merchant’s store; and
(iii) If the merchant allows a coupon with value of US$2 to be used on an order of US$19 or above, then an AE Member can use one (1) coupon (i.e. making up US$2 in value) when he/she makes a purchase of products of US$19 or more at that merchant store.
(e) Each AliExpress Select Coupon can only be used for products purchased at a single store within one purchase order, but multiple AliExpress Select Coupons can be used at a single store within the same purchase order.

9. Conflict of Terms and Conditions
(a) In case of any discrepancy in the content between the English and other non-English language versions of these Official Rules, the English version shall prevail.
(b) In the event that any of the terms under these Official Rules conflicts with the rules and/or any such related information displayed elsewhere on AliExpress.com, the terms under these Official Rules shall prevail.
10. Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE PROMOTER BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THIS PROMOTION, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE.
11. Disputes
You acknowledge and agree that the Promoter or any of its affiliates shall not be responsible, and shall have no liability to any Eligible Member or anyone else for any dispute or claim that arises out of your participation in the Promotion.
12. Governing Law
You agree that this Promotion is governed, interpreted and enforced by the laws of Hong Kong, without regard to its conflict of laws principles. Any and all legal actions, claims or proceedings arising out of, or in connection with this Promotion must be brought in a court of competent jurisdiction in Hong Kong.
13. Privacy Notice
This Privacy Notice applies to Promotion and sets out how Promoter and/or Sponsor will collect and use the personal data of participants for the duration of this Promotion.

During the Promotion Period, the Promoter and/or Sponsor will collect the following types of personal data from participants:
• Name (first and/or last)
• Username on social networks
• Publicly available image(s)/video(s) provided by the participant on social networks
• Place of residence
• Personal identification information
• Bank account information
• Contact
B. PURPOSE AND BASIS FOR COLLECTING DATA
Promoter will collect this data for the purpose of selecting a winner in the Promotion, assist Sponsor in collecting the data for the payment of any cash prizes, and any further purpose(s) stated here. Sponsor will collect the data for the purposes of paying any cash prizes. Data will be collected and used on the basis of the Promoter’ legitimate interest to serve as platform through which third parties may offer products and services to consumers, including via special offers and promotional activities. As stated in section D below, you have the right to object to this basis for processing your personal data.

C. SHARING OF DATA
Promoter will only share your personal data with Sponsor for the purposes of payment of any cash prizes, the third-party marketing firms who will be responsible for the direct realization of this Promotion and who are under appropriate contractual obligations to protect the personal data entrusted to them. Promoter may also share this data internally as necessary for the purposes of this Promotion.

D. STORAGE AND DELETION OF DATA
Promoter will only store participants’ personal data for as long as necessary to fulfill the purposes of this Promotion, after which time Promoter will delete this data.
E. RIGHTS CONCERNING DATA
Participants in the Promotion have rights concerning their data, including the right to access, rectify or erase their personal data, as well as the right to object to or restrict the processing of their personal data. If a participant objects to the processing of his personal data, or otherwise requests restriction or deletion, then the participant will no longer be able to participate in Promotion, and/or receiving any Offers (e.g., Coupons, or cash prizes). Participants also have the right to lodge a complaint about the processing of their personal data with the Supervisory Authority.
F. INTERNATIONAL TRANSFERS OF DATA
Promoter may transfer participants’ personal data to countries outside of the European Economic Area (“EEA”), including to countries that may not provide the same level of data protection as in a participant’s home country. In such cases, Promoter has taken appropriate steps to ensure that the recipients of personal data are bound to duties of confidentiality and appropriate contractual safeguards to ensure personal data will remain protected in accordance with this Privacy Notice – including, where applicable, standard contractual clauses.
